End User License Agreement

Subject to this Agreement, Galgotias University ("Licensor") grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use Swaniyam on Apple-branded devices that you own or control, solely for your personal, non-commercial use, as permitted by Apple's App Store Terms of Use and Usage Rules.

You may not

• Copy, modify, or create derivative works of the App except as expressly permitted by applicable law
• Reverse engineer, decompile, or disassemble the App except where such restriction is prohibited by law
• Rent, lease, lend, sell, redistribute, or sublicense the App
• Remove or alter any proprietary notices, labels, or marks
• Use the App for any unlawful purpose or in violation of any third-party rights
• Use the App to develop a competing product or service

You acknowledge and agree that:

• Apple has no warranty obligation whatsoever for the App
• Apple is not responsible for addressing any claims by you or any third party relating to the App
• Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you
• Your use of the App must comply with Apple's then-current App Store Terms of Service

The App and all content, features, functionality, code, design, and underlying technology ("Licensor Content") are owned by Galgotias University or its licensors and are protected by applicable intellectual property laws, including copyright, trademark, and trade secret laws under the Copyright Act, 1957 and the Trade Marks Act, 1999 of India.

• The Swaniyam name, logo, and all related marks are trademarks of Galgotias University
• You may not use any Licensor trademarks without prior written permission
• Nothing in this Agreement transfers any intellectual property rights to you
• Feedback or suggestions you provide may be used by Licensor without obligation to you

• Always seek the advice of a qualified physician or other health provider with any questions about medications, conditions, or treatment
• Never disregard professional medical advice or delay seeking it because of something you read or log in the App
• If you think you may have a medical emergency, call your local emergency number (India: 112) immediately
• Drug information (including content from third-party sources such as public drug labelling APIs) may be incomplete, outdated, or unsuitable for your situation
• You are solely responsible for verifying any medicine information with your pharmacist or physician before relying on it

In plain language: we've built Swaniyam with care, but we can't guarantee it will always work perfectly. Use your own judgement and always verify important health information with a professional.

You agree to indemnify, defend, and hold harmless Galgotias University and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

• Your use of or access to the App
• Your violation of any provision of this Agreement
• Your violation of any third-party right, including any intellectual property, privacy, or other proprietary right
• Any claim that content you submitted caused damage to a third party

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree not to:

• Use the App in any way that could damage, disable, or impair the service or others' use of the App
• Attempt to gain unauthorised access to any system, data, account, or network
• Upload, transmit, or distribute malware, viruses, or any harmful code
• Use the App to violate any applicable law or regulation, including the Information Technology Act, 2000
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Use automated scripts or bots to interact with the App in any unauthorised manner

The App relies on or links to third-party services including:

• Authentication providers (Apple, Google)
• Cloud infrastructure and database hosting (Supabase)
• Public medicine information APIs (DailyMed / U.S. National Library of Medicine)

Those services are governed by their own terms and privacy policies. We are not responsible for the content, availability, accuracy, or practices of any third-party service. Your use of third-party services is at your own risk.

Updates

We may provide updates to the App through the App Store. Updates may include bug fixes, new features, or changes to existing functionality and may be subject to additional or modified terms.

Modification of Agreement

We may modify this Agreement by posting an updated version in the App or on our website with a new effective date. We will notify you of material changes via in-app notice or email where reasonably possible. Continued use after the effective date constitutes acceptance of the updated Agreement.

Termination

We may suspend or terminate your license at any time, with or without notice, for conduct that we believe violates this Agreement or harms other users or Galgotias University. You may terminate this Agreement at any time by deleting the App from your devices.

Your use of the App is also governed by our Privacy Policy, which is incorporated into this Agreement by reference. Galgotias University processes your personal data in accordance with the Digital Personal Data Protection Act, 2023 (DPDP Act) and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011. Please review the Privacy Policy to understand how we collect, use, and protect your information.

The App is intended for users aged 18 and above. By using the App, you represent that you are at least 18 years old.

• Users under 18 may only use the App with verifiable parental or guardian consent, as required by the Digital Personal Data Protection Act, 2023
• If we become aware that a user under 18 has provided personal data without appropriate consent, we will promptly delete such data
• Parents or guardians who believe their child has used the App without consent should contact us at privacy@swaniyam.galgotiasuniversity.edu.in

You represent and warrant that:

• You are not located in a country that is subject to a government embargo or that has been designated as a terrorist-supporting country
• You are not listed on any government list of prohibited or restricted parties (including the U.S. Treasury Department's list of Specially Designated Nationals)
• You will not use the App in violation of any applicable export control laws or regulations, including those of India and the United States

This Agreement is governed by the laws of Uttar Pradesh, India, and applicable central Indian laws including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023, excluding conflict-of-law rules, except where mandatory consumer protection laws of your country of residence apply.

This Agreement, together with the Privacy Policy and any supplemental terms we provide, constitutes the entire agreement between you and Galgotias University regarding the App and supersedes all prior agreements and understandings relating to its subject matter.

• If any provision of this Agreement is held invalid or unenforceable, the remaining provisions will continue in full force and effect
• Our failure to enforce any right or provision of this Agreement will not be considered a waiver of those rights
• You may not assign this Agreement or any rights under it without Galgotias University's prior written consent
• Galgotias University may assign this Agreement freely, including in connection with a merger, acquisition, or sale of assets
